The Cabinet of Ministers has registered a bill in the Verkhovna Rada that provides for updating the rules in the field of vehicle registration and the issuance of driver's licenses in accordance with EU standards. In particular, access to driving categories will depend on the driver's age and experience, and vehicle registration and license issuance will become available through local authorities. Details
The bill "On Amendments to the Law of Ukraine 'On Road Traffic' regarding the implementation of legislation," which was approved on April 23 and registered on April 27, provides for new rules for vehicle registration according to EU standards, updated driver's license categories, and establishes new competencies for the Cabinet of Ministers in the field of road traffic. In particular, the government's competence is planned to include:
- approval of sample forms and technical descriptions of forms for national and international driver's licenses, vehicle registration certificates, and other registration documents, as well as the sample of the distinctive automobile sign of Ukraine;
- determining the procedure for the formation and verification of electronic driver's licenses, electronic vehicle registration certificates, and their electronic copies;
- determining the requirements for data contained in the electronic driver's license and electronic vehicle registration certificate, the procedure for their updating, and measures for the processing and protection of personal data of the holders of such documents;
- delegating powers to local self-government bodies to provide administrative services for vehicle registration and the issuance of driver's licenses.
The document establishes that every citizen of Ukraine, foreigner, or stateless person who permanently or temporarily resides in the territory of Ukraine, has no medical contraindications, has undergone a medical examination in the prescribed manner, and is admitted for health reasons to drive vehicles of the relevant categories, and has undergone training or retraining according to the relevant programs, may obtain the right to drive vehicles of the relevant categories.
A driver's license issued to a person for the first time is valid for two years from the date of its issuance.
The list of medical contraindications, in the presence of which a person cannot be admitted to drive vehicles of the relevant categories, will be determined by the Ministry of Health.
The draft law also provides for updating the categories for the right to drive vehicles. In particular, according to the document, the following driver's license categories for the right to drive vehicles are established in Ukraine:
- category AM, category A1, category A;
- category B1, category B, category BE;
- category C1, category C1E, category C, category CE;
- category D1, category D1E, category D, category DE;
- category Tm.
According to the bill, category AM includes mopeds or three-wheeled vehicles with a maximum design speed not exceeding 45 km/h, an engine displacement not exceeding 50 cubic centimeters, and a maximum rated power not exceeding 4 kW, except for those with a maximum design speed less than or equal to 25 kilometers per hour.
Also, category AM includes light quadricycles with an unladen mass not exceeding 350 kilograms (excluding the mass of batteries in the case of an electric motor), a maximum design speed not exceeding 45 km/h, an engine displacement not exceeding 50 cubic centimeters, and a power not exceeding 4 kW.
Category A1 is planned to include motorcycles with an engine displacement not exceeding 125 cubic centimeters, a power not exceeding 11 kW, and a power-to-weight ratio of no more than 0.1 kW/kg.
Category A2 is planned to include motorcycles and motorcycles with a sidecar with a power not exceeding 35 kW, a power-to-weight ratio of no more than 0.2 kW/kg, and which are not converted from a vehicle with a power exceeding 70 kW.
Category A is planned to include motorcycles and motorcycles with a sidecar with a power exceeding 35 kW, as well as tricycles with a power exceeding 15 kW.
Category B1 is planned to include quadricycles with an unladen mass not exceeding 400 kilograms (550 kilograms for vehicles intended for carrying goods), excluding the mass of batteries in the case of an electric motor, with a power not exceeding 15 kW.
Category B - vehicles with a maximum authorized mass not exceeding 3500 kilograms, designed and constructed for the carriage of passengers with no more than eight seats in addition to the driver's seat. Vehicles in this category may be combined with a trailer with a maximum authorized mass not exceeding 750 kilograms.
Category BE - a combination of vehicles consisting of a category B towing vehicle and a trailer or semi-trailer, provided that the maximum authorized mass of the trailer or semi-trailer does not exceed 3500 kilograms.
Category C1 - vehicles (other than those in category D1 or category D) with a maximum authorized mass exceeding 3500 kilograms but not exceeding 7500 kilograms, designed and constructed for the carriage of passengers with no more than eight seats in addition to the driver's seat.
Category C1E - a combination of vehicles consisting of a category C1 towing vehicle and a trailer or semi-trailer with a maximum authorized mass exceeding 750 kilograms, provided that the maximum authorized mass of such a combination does not exceed 12,000 kilograms.
Category C - vehicles (other than those in category D1 or category D) with a maximum authorized mass exceeding 3500 kilograms, designed and constructed for the carriage of passengers with no more than eight seats in addition to the driver's seat.
Category D1 - vehicles designed and constructed for the carriage of passengers with more than eight but no more than sixteen seats in addition to the driver's seat, with a maximum length not exceeding 8 meters.
Category D - vehicles designed and constructed for the carriage of passengers with more than eight seats in addition to the driver's seat.
Category Tm - tram and Tb - trolleybus.
The document also defines the age from which the right to drive vehicles will depend.
In particular, the right to drive vehicles of the relevant categories may be granted to:
- category AM - from 15 years of age;
- categories A1, B1 - from 16 years of age;
- categories A2, B, BE, C1, C1E - from 18 years of age.
The right to drive vehicles of categories B and BE may be granted from the age of 17, provided the vehicle is driven accompanied by a person who has had the right to drive vehicles of equivalent categories for at least two years.
For category A, it is planned to establish that this category can be driven by persons who have reached the age of 20 and have had the right to drive a category A2 vehicle for at least two years (the requirement for the right to drive does not apply if the person is at least 24 years old).
Vehicles of category C and CE can be driven by persons who have reached the age of 21, as well as persons who have reached the age of 18, provided they have a document of professional education on obtaining the profession of a driver of vehicles of the relevant categories.
The right to drive wheeled tractors, self-propelled machines, agricultural machinery, and other mechanisms operated on the road network of all types may be granted to persons who have reached the age of 18.
Currently, the law "On Road Traffic" establishes that the right to drive vehicles of the relevant category may be granted to:
- motor vehicles and motorized wheelchairs (categories A1, A) – to persons who have reached the age of 16;
- cars, wheeled tractors, self-propelled machines, agricultural machinery, and other mechanisms operated on the road network of all types (categories B1, B, C1, C, T), except for buses, trams, and trolleybuses - to persons who have reached the age of 18;
- cars with trailers or semi-trailers (categories BE, C1E, CE), as well as those intended for the transportation of oversized, heavy, and dangerous goods - to persons who have reached the age of 19;
- buses, trams, and trolleybuses (categories D1, D, D1E, DE, T) - to persons who have reached the age of 21.
In addition, the government bill defines the reasons for the termination of a driver's license. In particular, in case of deprivation of the right to drive; establishment of the fact of processing and issuing a driver's license on the basis of forged/invalid/fictitious documents.
