Invitation to Canada does not guarantee obtaining a visa: lawyer explains what migration officers actually evaluate

The lawyer explained that having an invitation is not a decisive factor for a visa.

Having an invitation from relatives or friends in Canada is not a decisive factor for obtaining a visitor visa. Canadian immigration authorities assess the application comprehensively, analyzing not only the invitation letter but also the applicant's financial situation, social ties, and other documents. This was reported to UNN by immigration lawyer Valeriia Nahorna of "LOGIC Law Firm" LLC.

According to her, many Ukrainians still believe that an invitation from relatives significantly increases the chances of obtaining a Visitor Visa. However, in practice, this document only confirms the purpose of the trip, the nature of the relationship between the parties, and the planned period of stay in Canada.

"Many applicants believe that the main document is the invitation letter. In reality, the officer analyzes the entire package of documents. Proof of income, documents on employment or business, property, family circumstances, and other factors are important. An invitation can supplement the case, but it cannot replace documents that characterize the applicant themselves," Nahorna noted.

The lawyer explained that during the review of an application, the immigration officer assesses the applicant's financial capacity, stability of income, employment or business operations, ownership of property, marital status, previous travel history, and other circumstances that confirm the intention to return to the country of residence after the trip.

According to the expert, special attention should be paid to the content of the invitation itself. It should be concise and contain only the necessary information: who is inviting the applicant, what their relationship is, the purpose of the planned trip, and its duration.

At the same time, overly emotional or excessively detailed letters may raise additional questions during the case review.

The lawyer separately drew attention to the issue of trip financing. If the costs are covered by a person residing in Canada, such circumstances must be properly explained and supported by documents. This is especially relevant in cases where the applicant is a student, on parental leave, or for other reasons cannot pay for the trip themselves.

"Very often, people prepare an invitation letter or explanatory letters on their own, using templates from the internet. As a result, the document may contain unnecessary information, contradict other case materials, or create questions where there were none initially. That is why preparing such documents requires not only knowledge of the requirements but also an understanding of how the immigration officer will evaluate them in the context of the entire case," Nahorna explained.

According to the expert, all documents in a visa case should logically complement each other and confirm the circumstances cited by the applicant.

"Each document in the case should complement other materials, not contradict them. It is important to understand the causal relationships between all circumstances: who is financing the trip, why this particular person is covering the costs, what relationship exists between the parties, why the applicant is traveling right now," Nahorna concluded.

The lawyer emphasized that neither having relatives in Canada nor the invitation letter itself guarantees obtaining a visitor visa. The completeness and quality of document preparation, their reliability, and consistency with each other are decisive.
