A draft law on local administrations is being prepared for consideration in the Verkhovna Rada, the Ministry of Community Development, Territories and Infrastructure reported, UNN writes.

"This draft law establishes administrative supervision over the decisions of local governments in accordance with the European Charter of Local Self-Government," the ministry said.

It is also stated that the draft law "proposes a new mechanism for the selection and appointment of local state administrations".

According to Oleksandr Kubrakov, Deputy Prime Minister for the Restoration of Ukraine and Minister of Community Development, Territory and Infrastructure, the adoption of this draft law No. 4298 "is crucial for consolidating the results of the decentralization reform.

According to Olena Shulyak, head of the Verkhovna Rada's relevant committee, the approved €50 billion Ukraine Facility Plan pays special attention to promoting decentralization.

"This is not about restricting the rights of local self-government, but about implementing best practices based on the European Charter of Local Self-Government," said MP Olena Shulyak, speaking about the draft law.

It is noted that the key provisions of the draft law are "the creation of a legal framework for the functioning of local state administrations of the prefectural type until the Constitution of Ukraine is amended." The powers and tasks of local state administrations are divided into key areas:

  • coordination of territorial bodies of central executive authorities;
  • ensuring legality in the activities of local government bodies and officials;
  • Exercise of sectoral powers and certain powers of local governments.

Also, the heads of local state administrations and their deputies are reportedly granted the status of civil servants, which implies increased requirements for applicants for these positions, such as experience and seniority, knowledge of the law, etc. If the draft law is passed, the term of office of the heads of regional and district state administrations will be up to 5 years within the same administrative unit.

The new system of supervision over the legality of local government decisions also stipulates that in case of discrepancies between such decisions and the Constitution and/or laws of Ukraine, the local state administration will propose to the local government to eliminate such discrepancies within 30 business days. And in case of failure to eliminate the violation, the LSAs will file a lawsuit to cancel such a decision.

"The draft document is now at the final stage of consideration and will be submitted to the parliament for consideration after the amendments discussed during the consultations," the ministry said.
