Employers are going to be obliged to create a mental health service: Rada adopts law as a basis

The Rada supported a bill to establish mental health services at enterprises. Companies with 50+ employees will have to set up separate services, while smaller ones will have to hire part-time specialists.

The Verkhovna Rada has supported as a basis a bill that would oblige employers to create a mental health service in the future. This is reported by UNN with reference to MP Yaroslav Zheleznyak and the card of the bill No. 12030.

"No. 12030 - On the system of mental health care in Ukraine - as a basis (236)," said Zheleznyak.

According to the draft law, employers must establish a mental health service and develop and approve a policy or plan to protect and promote mental health in the workplace.

"An employee has the right to psychosocial support in the workplace, for which the employer takes measures defined by law, develops and implements a policy or plan for the protection and promotion of mental health in the workplace," the document says.

It is noted that an employer with 50 or more employees shall establish a mental health service.

At an enterprise with fewer than 50 employees, the functions of a mental health service may be performed on a part-time basis by persons with appropriate training.

At an enterprise with fewer than 20 employees, third-party specialists with appropriate training may be contracted to perform the functions of a mental health service.

The functions and powers of mental health care and its model regulations are approved by the Cabinet of Ministers.
