On January 1, 2024, the subsistence minimum for children increased in Ukraine. This also affected the amount of alimony. This was reported by the Ministry of Justice of Ukraine, UNN reports.
Details
It is noted that alimony payments are a mandatory procedure and are collected from all types of income of the payer
According to part 2 of Article 182 of the Family Code of Ukraine, the minimum guaranteed amount of child support per child is not less than 50% of the subsistence minimum for a child of the corresponding age.
On November 09, 2023, the Verkhovna Rada of Ukraine adopted the Law of Ukraine "On the State Budget of Ukraine for 2024", which increased the subsistence minimum:
- for children under 6 years of age - UAH 2,563;
- for children aged 6 to 18 - UAH 3,196.
Therefore, according to the Ministry, from January 2024, the minimum guaranteed amount of alimony will be as follows:
- for children under 6 years of age - UAH 1,281.5;
- for children aged 6 to 18 - UAH 1,598.
How to determine the amount of alimony
Taking into account the factor of the number of children, the calculation scheme is as follows:
- ▫️ per child - ¼ of the income;
- ▫️ for two - 1/3 of the income;
- ▫️ for three or more - ½ of the income.
However, the court may also take into account, among other things, the health and financial situation of the child and the alimony payer, the presence of other children and disabled relatives (husband, wife, parents, daughter, son), property rights (real estate, car, etc.), expenses/income of the payer, etc.
What is the difference between the guaranteed amount of alimony and the recommended amount
The guaranteed amount of child support per child is the minimum amount that a parent pays if their income is low. The recommended amount is the amount set by the court if the alimony payer's earnings are sufficient.
As for the maximum amount of alimony, it cannot exceed 10 subsistence minimums:
- up to 6 years - UAH 25,630;
- from 6 to 18 years old - UAH 31,960.
