South Africa's request for a ceasefire in Gaza: Israel is convinced of its case, but the case remains in the International Court of Justice

Despite South Africa's lawsuit against Israel for violating the UN Convention, top South African judge Nambita Dambuza recognizes that the IDF is difficult to contain in the Gaza Strip. However, bringing the case has brought publicity to the alleged violations, the South African spokeswoman added. Writes UNN citing France24.

Details

The case of the state concerned, Israel, is so deep, and they are convinced they are right, and they know that it is unlikely that anything will happen if they continue their behavior

 - Nambita Dambuza, a judge on the appeals court of South Africa's Supreme Court, told Agence France-Presse.

It complained that Israel faced few restrictions in waging war. There is a binding legal force in the judgment of the International Court of Justice. However, the court has no concrete means to enforce them.

At the same time, "it did put pressure on," Dambuza said.

While this process has not resulted in any tangible relief .... bringing these issues into the public eye gives the public an opportunity to see justice - or attempts at justice.

Help

The South African case, filed in December 2023,alleges that Israel's offensive in Gaza, launched in response to an unprecedented Hamas attack on Israel, violated the 1948 UN Genocide Convention. Israel vigorously denies these allegations.

South Africa has appealed to the International Court of Justice several times, arguing that the court should take new emergency measures due to the dire humanitarian situation.

In a January 26 ruling, the International Court of Justice ordered Israel to do everything possible to prevent acts of genocide during the military operation in Gaza.

Spain said last month it would join with several Latin American countries in a lawsuit by South Africa - a move that has led to several rulings against Israel.

Recall
