The Pechersk District Court of Kyiv denied the defense's motion to close the criminal proceedings against Yuriy Chernetsky, who is accused of systematic illegal sale of cocaine in nightclubs and storage of ammunition without a permit. This was reported by the Kyiv City Prosecutor's Office, UNN reports.
"Under the procedural guidance of the Kyiv City Prosecutor's Office, the Pechersk District Court continues to consider the case on charges of a 50-year-old Kyiv resident of systematic illegal sale of cocaine in nightclubs and storage of ammunition without a permit provided by law (Part 1 of Article 267 of the Criminal Code of Ukraine, Part 2 of Article 307 of the Criminal Code of Ukraine)," the statement said.
It is reported that today during the court hearing, the defendant's lawyers filed a motion to close the criminal proceedings.
"Due to the principled position of the prosecutors of the Kyiv City Prosecutor's Office, the Pechersk District Court of Kyiv denied the defense's motion," the statement said.
The prosecutor's office notes that in May 2023, the defendant's lawyers had already tried to have this criminal proceeding closed, pointing to the alleged expiration of the pre-trial investigation. At that time, the court granted the defense lawyers' motion and closed the criminal proceedings.
"Considering this decision illegal, the prosecutors of the Kyiv City Prosecutor's Office appealed the decision to close the case to the Kyiv Court of Appeal. The court overturned the illegal ruling and sent the case back for further consideration," the prosecutor's office said.
The trial is currently ongoing. A custody was chosen as a measure of restraint against the accused.
