The Verkhovna Rada Committee on Legislative Support of Law Enforcement recommends the adoption of a draft law on liability for evading mobilization with reduced fines and no imprisonment for refusing to undergo a medical examination.

The Verkhovna Rada Committee on Law Enforcement recommends that the parliament adopt a draft law on liability for evading mobilization, but in a new version. In particular, the committee proposes to reduce fines for evading mobilization several times and to remove the provision that provided for a sentence of up to 5 years in prison for refusing to undergo a medical examination. This was reported by MP Oleksandr Bakumov, UNN reports.

According to Bakumov, the Committee on Law Enforcement recommends to the Rada a new version of the draft law on liability for evading mobilization - No. 10379.

"There will be no changes to the Criminal Code of Ukraine at all. Amendments to the Code of Ukraine on Administrative Offenses: the term for imposing administrative penalties (Article 38 of the Code of Administrative Offenses) was reduced from 3 years (CMU version) to 1 year," Bakumov said.

The new version of the draft law also establishes fines for violation of the rules of military registration): in peacetime - from UAH 3,400 to 5,100; in a special period - from UAH 17,000 to 25,500.

Fines for violation of the legislation on defense, mobilization preparation and mobilization for citizens: in peacetime - from UAH 5100 to 8500; in a special period - from UAH 17000 to 25500. For officials and employees of government authorities, enterprises, institutions, and organizations: in peacetime - from UAH 17,000 to 34,000; in a special period - from UAH 34,000 to 5,9500.

"We are not making any changes to Art. 263 of the Code of Administrative Offenses regarding the terms of administrative detention. The CMU's version proposed detention for up to three days to identify the person and/or clarify the circumstances of the offense. The TCC will issue a resolution without drawing up a protocol in case of offenses under Articles 210, 210-1 of the Code of Administrative Offenses committed during the special period. The Committee has just recommended the draft law to the Verkhovna Rada to adopt it as a basis and as a whole," Bakumov added.

Addendum

In late December, the Cabinet of Ministers introduced a bill that would increase fines for violations of military registration and defense legislation, as well as mobilization training and mobilization.

In particular, it is proposed to establish a fine in the amount of UAH 34,000 - 85,000 for violation of the legislation on defense, military duty and military service, mobilization training and mobilization.

During the special period, it is proposed to set fines at the level of UAH 153,000 - 204,000. The draft law also proposes to detain people for up to three days for violating the legislation on defense, military duty and military service, rules of military registration, mobilization preparation and mobilization.

It is also proposed to punish evasion from military service during mobilization (including refusal to undergo a medical examination), for a special period, for military service by conscription of persons from among reservists during a special period by imprisonment for a term of three to five years.
