Military personnel will be able to determine the recipient of one-time allowance in case of their death: law signed

Starting in April 2024, Ukraine's defenders will be able to determine the recipient of a one-time financial assistance in the event of their death. The relevant law was signed by President of Ukraine Volodymyr Zelenskyy on December 28, according to the parliament's website, UNN reports.

As reported in the Committee on Social Policy and Protection of Veterans' Rights, the law establishes the right to draw up a personal order in the event of one's death to pay a one-time financial assistance to the following categories of citizens:

-         to persons holding the rank of private or commander of the civil defense service;

-         military personnel, persons liable for military service or reservists (called up for training (or check-up) and special training or for service in the military reserve);

-         employees of critical infrastructure facilities;

-         civil servants;

-         to local government officials;

-         police.

After the regulatory acts of the Cabinet of Ministers of Ukraine are brought into compliance with this law, the above categories of citizens will be able to determine to whom and in what percentage a one-time financial assistance will be paid in the event of their death or death.

At the same time, regardless of the content of the personal order, minors, adult disabled children, disabled widows (widowers) and disabled parents of the deceased person are entitled to a one-time financial assistance.

In the absence of a personal order, they are entitled to the corresponding share of the one-time financial assistance:

-         children, including adopted children conceived during the life of the deceased person and those born after his/her death;

-         children in respect of whom the deceased person was deprived of parental rights during his/her lifetime;

-         one of the spouses who survived the deceased person;

-         parents (adoptive parents) of the deceased person, if they were not deprived of parental rights in relation to the deceased person or their parental rights were restored at the time of his/her death;

-         grandchildren of the deceased person, if their parents died at the time of his/her death;

-         a woman (man) with whom the deceased person lived as a family, but were not married to each other or in any other marriage (provided that this fact is established by a court decision that has entered into force);

-         dependents of the deceased person, determined in accordance with the Law of Ukraine "On Pension Provision for Persons Discharged from Military Service and Certain Other Persons".

The government should bring its regulations in line with the law to ensure that from April 2024 it will be possible to draw up a personal order.
