Increase in excise taxes on fuel: Parliament plans to consider draft resolutions blocking the signing of the law

The Verkhovna Rada plans to consider draft resolutions blocking the signing of the law on raising the excise tax on fuel. The MPs argue that this is a violation of the rules of procedure when adopting the bill.

At the next meeting of the Verkhovna Rada, it is planned to consider draft resolutions that block the signing of the bill on increasing the excise tax on fuel. This was reported by UNN with reference to the agenda of the Verkhovna Rada meeting and draft resolutions No. 11256-2-P1 and No. 11256-2-P2.

Details

The respective draft resolutions are aimed at canceling the Rada's decision to adopt in the second reading and as a whole the draft law of Ukraine "On Amendments to the Tax Code of Ukraine on the Implementation of the Provisions of the European Union Law on Excise Tax" (Reg. No. 11256-2).

The MPs argue that the relevant draft law was adopted in violation of Article 117, paragraph 1, of the Verkhovna Rada's Rules of Procedure.

Article 117 of the Rules of Procedure stipulates that a draft law prepared for the second or repeated second reading, the opinion of the main committee and other supporting documents to it are provided to MPs no later than ten days before the day of consideration of the draft law at the plenary session of the Verkhovna Rada.

However, these documents regarding the version of the draft law that was put to vote were provided to MPs only on July 10, eight days before the day of the draft law's consideration at the plenary session of the Verkhovna Rada. As a result, MPs were deprived of the opportunity to properly study and prepare for the consideration of the draft law, which could have resulted in the failure to take into account a number of amendments to the draft law

Addendum 

On July 18, the Parliament passed in the second reading the draft law on increasing the excise tax on fuel. In particular, the excise tax on gas was increased for the second reading. In the first reading, it was assumed that the excise tax on gas in 2028 would be 70 euros, but by the second reading, the excise tax was significantly increased to 250 euros.

If the MPs fail to vote for the draft resolutions, which requires that they do not get 226 votes, the bill will be sent to the Speaker of the Verkhovna Rada Ruslan Stefanchuk for signature, and then to President of Ukraine Volodymyr Zelenskyy for signature.
