Ukrainian Parliamentary Commissioner for Human Rights Dmytro Lubinets  responded to a bullying scandal in a Kyiv school where a teenager was beaten until his testicles burst. The Ombudsman emphasizedthat responsibility for bullying lies not only with the perpetrator, but also with those who conceal such cases, UNN reports.

In Kyiv school #81, a 13-year-old student was beaten by his peers. The consequences are glaring. The child was operated on only the 10th day after receiving a severe injury to the groin, because the boy did not say anything to his parents.  ... I would like to remind you that responsibility for bullying applies not only to its commission, but also to the concealment of such cases.

Details

According to Lubinets, the student who was beaten at school was in an inclusive education program. There is a teacher's assistant in the classroom. The Ombudsman was told about this by the mother of the boy who was the victim of bullying. In her appeal, the mother also said that she had repeatedly complained to the school administration and asked them to take measures to create safe conditions for education.

In particular, during the break, due to the absence of teachers on duty, the child became a victim of bullying by other students. In addition, the teenager had previously been subjected to psychological humiliation and physical abuse.

The boy's mother asked Mr. Lubinets to take control of the situation and assist in the investigation into the bullying at the school. The Ombudsman, in turn, filed a complaint with the police and sent a request to the school's founder, the Dniprovskyi District State Administration in Kyiv, to conduct an internal investigation into the proper performance of duties by the school's employees, whose responsibilities include monitoring the protection of children's rights and interests.

I emphasize that the right to protection from violence, attacks on honor and dignity is defined by Article 19 of the Convention on the Rights of the Child, Articles 28 and 52 of the Constitution of Ukraine , and Article 10 of the Law of Ukraine "On Protection of Childhood". No one may be subjected to harassment, torture, or ill-treatment. Any violence against a child shall be prosecuted by law.

Earlier UNN reported, that criminal proceedings had been initiated over the incident under Part 1 of Article 125 of the Criminal Code of Ukraine - intentional light bodily harm. As part of the criminal proceedings, investigators will establish all the circumstances of the incident.
