Draft law on the possibility to “pay off” from punishment for corruption: SAPO announces amendments to the document

The SAPO and NABU met with the Verkhovna Rada Committee on Draft Law 11340 on 'payoffs' from punishment for corruption. The parties agreed to make changes to eliminate corruption risks.

The NABU and SAPO leadership held a working meeting with representatives of the Verkhovna Rada Committee on Law Enforcement. They discussed draft law No. 11340, which would allow people to “pay off” corruption by paying a fine. The parties agreed to amend the draft law to eliminate  corruption risks.  This was reported by UNN with reference to the press service of the Specialized Anti-Corruption Prosecutor's Office.

As noted, the NABU and the SAPO still insist on the need to finalize the draft law.

 Call for the following conditions to be stipulated in the document when concluding a plea agreement:

  • The organizer of a crime may be exempted from serving a sentence with probation or sentenced to a sentence lower than the lower limit provided for such a crime only if two conditions are met simultaneously: the organizer exposes another organizer and compensates for damages.
  • Application to other persons who are not organizers of the crime, exemption from serving a sentence with probation for a particularly serious crime or imposition of a sentence lower than the lower limit provided for such a crime is possible only if two conditions are simultaneously met: exposure of other persons and compensation for damages.

“Without these changes, corruption risks will remain in the draft law,” the SAPO said.

Following the meeting, the parties agreed to amend the draft law to ensure proportionality, efficiency and effectiveness of punishment for corruption crimes. Once finalized, the NABU and the SAPO will publish an assessment of the draft law for the second reading.
