Danylo Hetmantsev, chairman of the Verkhovna Rada Committee on Finance, Taxation and Customs Policy , wants to create a "white business club" to further unbalance the already unstable business environment or to create preferences for companies close to him. This opinion was expressed in an exclusive commentary by Serhiy Dorotych, head of the #SaveFOP movement.
In his Telegram channel, Hetmantsev said that he and his colleagues had prepared a draft law on the "white business club". According to him, the essence of the document is that "if an entrepreneur meets simple and transparent criteria for paying taxes above the industry average and paying a salary higher than the industry average, he will not be subject to tax control in the form of inspections. This is among other advantages. The list is reviewed quarterly.
"In our country, the presumption of innocence applies de jure, and until you are recognized as a non-taxpayer, you cannot say that you are white, gray or whatever until you have proven the opposite. So what does white business mean? Either the tax authorities have claims against you in terms of tax evasion or they don't. If not, then everyone is automatically white. And this is 99% of business. That is, the question arises whether this list will include 99% or whether it will include the owners of those companies that are close to Hetmantsev or other officials. Will everyone who has no claims against the tax authorities be included? Because if there are no complaints, they are white," Dorotych said.
He reminded that the law sets the amount of taxes, and the tax authorities have claims against those who do not pay them. The expert added that he did not understand what preferences could be given to "white business".
"What do you mean by preferences for 'whites'? We don't have a situation where I want to pay more taxes, or I want to pay less. There are requirements - they are clear - the amount of value-added tax, income tax - they are defined, and you either pay them and there are no claims against you, or you don't pay them and there are claims against you. Therefore, this is a deliberate action to further muddy the waters, to further introduce misunderstanding into an already unstable economy and an unstable business environment. Business does not know what to do now and is rushing left and right to survive. To make things even more muddled, or to actually create preferences for certain close business structures close to Hetmantsev or the government and play some games and scams with them," Dorotych said.
According to him, the legislative initiative to create a "club of white businesses" has nothing to do with the legal component.
"The question to this saboteur is, on what basis does a 'white' or 'non-white' get there? For example, I'm an entrepreneur, I pay taxes, I should be automatically included. Do I have to tell someone to prove that I am white?" Dorotych asked.
